COMMERCIAL LITIGATION AND DISPUTE RESOLUTION

This team supports the other commercial departments and so there is a close working relationship with the departments and the client in order to promote best understanding of the commercial issues, as well as the legal issues involved, in the dispute.

It gives practical and business like advice with the aim of resolving disputes as quickly and as economically as possible for the client. We advise and represent in the Courts, but also on adjudication, arbitration and mediation cases, and including representation at the employment tribunals.

The following represent just a few of the typical questions and situations arising for business clients:-

• “They haven’t paid for my goods and now they have gone bust. Can I get the goods back?”
• “The computer doesn’t work. The suppliers keep trying to repair it, but my business is suffering. What can I do?”
• “My ex-employee has opened up down the road and is taking my business away. Can I stop them?”
• “The other directors in my company have changed the locks at the factory and told me not to come back. What are my rights?”
• “the sub-contractor has just walked off site and is demanding money. Do I have to pay him? Who is going to finish the job?”

The circumstances are different in each situation. In some cases it is better to avoid Court proceedings altogether; in others a strong approach is necessary to bring about a fair and quick conclusion. Our aim is to deliver you the right result.
